What Is Considered Discrimination?

Direct discrimination is when a person is treated less favourably because of a protected characteristic such as age, a disability, race, religion or belief, or gender or sexual orientation. Indirect discrimination occurs where an apparently neutral provision, criterion or practice would put people of one sex/race/religion, for example, at a particular disadvantage compared with others.

How Long Do You Have to Bring a Claim?

An employee has 3 months from the date of the most recent act of discrimination to make a claim in the Employment Tribunal. This deadline is not extended by any internal grievance or disciplinary procedures that may be ongoing. Because this timeframe is usually strictly applied, we encourage you to seek guidance from one of our solicitors as soon as possible.
