Joelson successfully defends BCPL Limited in copyright infringement claim

Joelson, the London law firm, today announced that it has successfully defended BCPL Limited in a copyright infringement claim, issued by Ashley Wilde Group Limited.

BCPL manufactures and sells duvet covers and bed runners for the ‘By Caprice Home’ brand. Ashley Wilde manufactures and sells duvet covers for the ‘Kylie Minogue At Home’ brand. Ashley Wilde alleged similarities between BCPL’s ‘Amore’ duvet cover and bed runner and Ashley Wilde’s ‘Evangeline Design’ used in the Evangeline Duvet Cover.

Ashley Wilde’s claim relied on there being indirect copying of at least a substantial part of the Evangeline Design by the copying of the Evangeline Duvet Cover. BCPL robustly defended that claim and the Court has today dismissed Ashley Wilde’s claim.
