Terms of the Agreement: Are Bonuses Guaranteed or Discretionary?

Bonuses can be either contractual, discretionary or a mixture of both. This often means that, while you are entitled to the right to be considered for a bonus, your employer has the final say as to whether the bonus will be paid.

If your bonus is guaranteed under your contract regardless of individual performance, you are entitled to receive it from your employer. In these cases, if your employer fails to pay your contractual bonuses by the stated date, you may have a claim for recovery.
